1. Service Description
ATF GAMES, LLC ("Company," "we," "us," or "our") provides consulting services focused on game monetization strategy, user acquisition, and game analytics ("Services"). These Terms govern your use of our website and engagement with our Services. By accessing our website or engaging our Services, you agree to these Terms.
2. Engagement & Payment Terms
Client engagements are subject to a specific Statement of Work (SOW) or consulting agreement.
- Fees will be outlined in the applicable SOW.
- Invoices are generally due within 30 days unless otherwise specified.
- We may suspend Services when payments are overdue.
3. Confidentiality
We understand that game metrics, revenue data, and strategic plans are sensitive. ATF GAMES, LLC will hold client proprietary information in confidence and will not disclose it to third parties without prior written consent, except as required by law. A separate NDA may be executed upon request.
4. Intellectual Property
Clients retain all rights to their games, code, and pre-existing intellectual property. ATF GAMES, LLC retains rights to its pre-existing consulting methodologies, analytical frameworks, and tools. Reports and client-specific recommendations become the client's property upon full payment of associated fees.
5. Limitation of Liability
While we provide recommendations based on industry practice and data analysis, ATF GAMES, LLC does not guarantee specific financial results, ARPU increases, or CPI reductions. Our liability for claims related to the Services is limited to the amount paid for the specific Services giving rise to the claim during the six months before the event.
6. Termination
Either party may terminate an engagement as described in the applicable SOW. In the absence of specific terms, either party may terminate with 30 days' written notice. The client remains responsible for payment for Services rendered through the termination date.
7. Dispute Resolution
These Terms are governed by the laws of the State of Colorado. Disputes should first be addressed through good-faith negotiation and, if unresolved, binding arbitration in Grand Junction, Colorado.
